Terms & Conditions

Please read these terms carefully before using TransNexus services. By booking a shipment or using our platform, you agree to be bound by these terms.

1. Introduction

Welcome to TransNexus Global Logistics ("TransNexus", "we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of our logistics, freight forwarding, shipment tracking, and related services (collectively, the "Services"), whether accessed through our website, mobile platform, or directly through our operations team.

By placing a shipment booking, using our tracking platform, or engaging our services in any manner, you ("Client", "Sender", "Receiver", "User", "you") acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you and TransNexus Global Logistics. All shipments are governed by these Terms regardless of how the booking was initiated.

2. Definitions

For the purposes of these Terms, the following definitions apply:

  • "Shipment" means any package, parcel, document, cargo, freight, or consignment entrusted to TransNexus for transport.
  • "Sender" means the individual or entity originating the shipment and contracting with TransNexus.
  • "Receiver" means the individual or entity designated to receive the shipment.
  • "Tracking ID" means the unique alphanumeric identifier auto-generated for each shipment (format: TRK + digits).
  • "Carrier" means any third-party transport provider engaged by TransNexus to perform part or all of the transportation.
  • "Dangerous Goods" means items classified as hazardous under IATA, IMDG, ADR, or applicable national regulations.
  • "Customs Authority" means any government body responsible for regulating the movement of goods across international borders.
  • "Force Majeure" means events beyond the reasonable control of TransNexus, including but not limited to natural disasters, wars, pandemics, strikes, or government actions.

3. Service Usage

TransNexus provides logistics and freight services exclusively for lawful purposes. By using our Services you represent and warrant that:

  • You are at least 18 years of age or have the legal capacity to enter into contracts in your jurisdiction.
  • All information provided at the time of booking is accurate, complete, and not misleading.
  • You have the legal right to ship the items described in the shipment documentation.
  • You will not use our Services to transport any prohibited, illegal, or undeclared goods.
  • You will comply with all applicable local, national, and international laws governing the shipment of goods.

4. Booking & Acceptance

All shipment bookings are processed exclusively through our authorised admin portal or operations team. TransNexus does not operate a self-service customer booking portal.

4.1 Booking Confirmation

A shipment is considered accepted only upon issuance of a Tracking ID by TransNexus. You will receive confirmation via email details provided at the time of booking.

4.2 Accuracy of Information

You are solely responsible for the accuracy of all details submitted including sender/receiver names, contact numbers, email addresses, origin, destination, declared contents, and package dimensions. TransNexus shall not be liable for delays or losses resulting from inaccurate information.

4.3 Right to Refuse

TransNexus reserves the right to refuse, suspend, or cancel any shipment at its sole discretion, including shipments suspected to contain prohibited items, fraudulently booked shipments, or shipments that pose a risk to persons, property, or our operations.

5. Shipping Responsibilities

5.1 Sender's Obligations

  • Properly packaging and securing all items to withstand normal transit handling conditions.
  • Accurately declaring the contents, value, weight, and dimensions of the shipment.
  • Providing complete and accurate delivery address information.
  • Ensuring all required export licences, permits, and certificates are obtained prior to shipment.
  • Paying all applicable charges, duties, taxes, and fees associated with the shipment.

5.2 Packaging Standards

Items must be packaged to withstand normal handling conditions including stacking, vibration, moisture exposure, and temperature fluctuations typical of the selected transport method. TransNexus shall not be liable for damage resulting from inadequate packaging by the Sender.

5.3 Labelling

All shipments must bear the TransNexus-issued shipment label with the Tracking ID prominently displayed. Additional handling labels must be affixed by the Sender where applicable.

6. Payment Policies

6.1 Payment Terms

All freight charges, customs duties, taxes, fuel surcharges, and ancillary fees are payable as specified at the time of booking. TransNexus accepts payment via bank transfer, credit card, or other approved payment methods as communicated during the booking process.

6.2 Payment Hold

Shipments with a payment status of "Required" will be placed on hold. TransNexus shall not be obligated to release, continue, or complete transport of any shipment with outstanding payment obligations until all charges are settled.

⚠️ Shipments on payment hold may incur storage fees after 72 hours at the rate of USD $25 per day. Continued non-payment may result in return of the shipment to the Sender at the Sender's expense.

6.3 Duties and Taxes

All import duties, VAT, GST, customs taxes, and similar governmental charges are the sole responsibility of the Receiver, unless a Delivered Duty Paid (DDP) agreement has been expressly confirmed in writing by TransNexus at the time of booking.

6.4 No Refunds on Completed Shipments

Freight charges are non-refundable once a shipment has been collected by TransNexus or its carriers.

7. Delivery Conditions

7.1 Estimated Delivery Dates

Estimated delivery dates are provided as guidance only and are not guaranteed unless a specific guaranteed delivery service has been explicitly purchased.

7.2 Delivery Attempts

If delivery cannot be completed, TransNexus or its carrier may make up to two (2) delivery attempts. After failed attempts, the shipment may be held at a local facility or returned to the Sender at the Sender's expense.

7.3 Proof of Delivery

A shipment is considered delivered upon obtaining a signature from the Receiver or an authorised representative at the designated delivery address.

8. Prohibited Items

The following items are strictly prohibited from being shipped via TransNexus under any circumstances:

  • Narcotics, controlled substances, and illegal drugs of any kind.
  • Firearms, weapons, ammunition, and explosive devices (unless shipped under a specific licensed agreement).
  • Counterfeit goods, pirated materials, or any items infringing upon intellectual property rights.
  • Human remains, ashes, or body parts (without prior written authorisation and requisite licences).
  • Stolen goods or items obtained through unlawful means.
  • Radioactive, toxic, or biohazardous materials not compliant with applicable transport regulations.
  • Any item whose transportation is prohibited by law in the country of origin, transit, or destination.

⚠️ Shipments found to contain prohibited items will be immediately seized and reported to relevant authorities. No refund will be issued. The Sender shall bear full legal and financial responsibility.

9. Animal Transport

TransNexus provides specialised live animal transport services in strict compliance with IATA Live Animals Regulations, CITES, and all applicable national and international animal welfare laws.

9.1 Pre-Approval Required

All live animal shipments require pre-approval at least 72 hours before the scheduled collection date.

9.2 Documentation

The Sender is responsible for obtaining all required documentation including veterinary health certificates, CITES permits, import/export permits, vaccination records, and breed-specific documentation.

9.3 Liability for Animals

While TransNexus exercises all reasonable care in the transport of live animals, we cannot guarantee the health or survival of animals during transit. TransNexus strongly recommends obtaining comprehensive animal transport insurance prior to shipping.

10. Liability & Disclaimers

10.1 Limitation of Liability

To the maximum extent permitted by applicable law, TransNexus's liability for loss, damage, delay, or non-delivery is limited to the lesser of:

  • The declared value of the shipment at the time of booking; or
  • USD $100 per shipment for standard services; or
  • The actual freight charges paid for the specific shipment.

10.2 Claims Procedure

All claims for loss, damage, or delay must be submitted in writing to TransNexus within seven (7) calendar days of the scheduled delivery date. Claims submitted after this period will not be considered.

11. Customs & Compliance

The Sender is responsible for ensuring full compliance with all customs regulations. TransNexus acts as an agent in customs matters but assumes no liability for delays, fines, confiscation, or additional charges arising from incomplete or non-compliant customs declarations.

12. Service Exceptions

TransNexus uses a structured exception management system: On Hold, Delayed, Delivery Attempt Failed, Address Issue, Customs Hold, Seized, and Returned to Sender.

13. Privacy & Data

TransNexus collects and processes personal data solely for the purpose of providing logistics services, tracking communications, and regulatory compliance. We do not sell or share personal data with third parties except where required by law or for the operational purpose of completing your shipment.

Shipment data is retained for a period of five (5) years for regulatory and audit purposes. Contact us at support@transnexuss.com to request data deletion.

14. Notifications

By providing your email address and phone number, you consent to receive automated transactional notifications regarding your shipment via email. Transactional notifications cannot be opted out of during an active shipment as they constitute essential service communications.

15. Termination of Service

TransNexus reserves the right to suspend or terminate service to any individual or entity that violates these Terms, engages in fraudulent conduct, or poses a risk to the safety or integrity of our operations.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Unresolved disputes shall be submitted to binding arbitration under the rules of the London Court of International Arbitration (LCIA).

17. Amendments

TransNexus reserves the right to modify these Terms at any time. Revised Terms will be published on our website with an updated effective date. Continued use of our Services after publication constitutes acceptance of the changes.
